Terms of Purchase and Service
INFORMATION TO BE PROVIDED TO THE TRAVELER BEFORE CONCLUSION OF A COMPLEX OR RELATED TOURISM SERVICE CONTRACT.
The set of tourism services offered to you is a complex tourism service in accordance with the Tourism Law and Cabinet of Ministers Regulation No. 26 of June 2018. 380 in the sense of “Rules on the procedure for the preparation and provision of complex and related tourism services and the rights and obligations of providers of complex and related tourism services and travelers”. You will be able to use all the provisions of the Tourism Law and Cabinet of Ministers regulations of June 26, 2018 No. 380 “Rules on the procedure for the preparation and provision of complex and related tourism services and the rights and obligations of providers of complex and related tourism services and travelers”, the rights referred to in relation to complex tourism services.
SIA ATLANTIC TRAVEL, registration no. 40003692248 will be fully responsible for the proper provision of the complex tourism service as a whole.
In accordance with legal requirements, SIA ATLANTIC TRAVEL, registration no. 40003692248 is a guarantee that, in case it fails to fulfill or fails to fulfill its obligations due to its liquidity problems, it will reimburse your payments and, if the complex tourism service includes transport, – ensure your repatriation.
More information about the Tourism Law and Cabinet of Ministers regulations of June 26, 2018 no. 380 “Regulations on the procedure for the preparation and provision of complex and related tourism services and the rights and obligations of complex and related tourism service providers and travelers” http://www.likumi.lv or the provisions of the Tourism Law https://likumi.lv/doc.php?id=50026 and Cabinet of Ministers regulations of June 26, 2018 No. 380 “Regulations on the procedure for the preparation and provision of complex and related tourism services and the rights and obligations of complex and related tourism service providers and travelers”, if the contract is concluded in person, electronically or using phone conversation.
Fundamental rights in accordance with the Tourism Law and the Cabinet of Ministers’ regulations of June 26, 2018 No. 380 “Rules on the procedure for the preparation and provision of complex and related tourism services and the rights and obligations of providers of complex and related tourism services and travelers”:
- the traveler receives all relevant information about the complex tourism service before concluding the complex tourism service contract;
- there is always at least one tourism service provider who is responsible for ensuring that all tourism services included in the contract are properly provided;
- the traveler is given a telephone number for communication in emergency cases or information about a contact point where he can contact a tour operator or travel agent;
- the traveler can transfer the complex tourism service to another person by notifying him within a reasonable period of time (the obligation to cover additional costs may be stipulated for this);
- the price of the complex tourism service can be increased only if certain costs (for example, fuel prices) increase and if this is clearly stipulated in the contract of the complex tourism service, and in any case not later than 20 days before the start of the complex tourism service. If the price increase exceeds 8% of the price of the complex tourist service, the traveler can terminate the contract. If the tour operator reserves the right to increase the price, the traveler has the right to a price reduction if the relevant costs decrease;
- the traveler can terminate the complex tourism service contract without paying any termination fee and receive a full refund of the payments made, if any of the essential elements of the complex tourism service are significantly changed, except If the tourism service provider responsible for the complex tourism service cancels the complex tourism service before the start of the complex tourism service, the traveler has the right to receive a refund and – if applicable – compensation;
- in exceptional cases, the traveler can terminate the package tour service contract without paying any termination fee before the start of the package service, for example, if there are serious security problems at the destination that would likely affect the package tour service;
- the traveler can terminate the contract at any time before the start of the complex tourism service by paying a reasonable and reasonable termination fee;
- if, after the start of the complex tourism service, important elements of the complex tourism service cannot be provided as stipulated in the agreement, appropriate alternative solutions must be offered to the traveler at no additional cost. The traveler can terminate the complex tourism service contract without paying the termination fee, if the services are not provided in accordance with the contract and this significantly affects the performance of the complex tourism service, and the tour operator does not fix the problem;
- the traveler has the right to a price reduction or compensation for losses if tourism services are not provided or provided inappropriately;
- if the traveler gets into difficulties, the tour operator is obliged to provide assistance;
- if the tour operator is partially or completely unable to fulfill its obligations due to its liquidity problems, the payments made by the traveler are refunded. If the tour operator is partially or completely unable to fulfill its obligations after the start of the package tour service due to its liquidity problems and the transport is included in the package tour service, the repatriation of the traveler is ensured.
SIA ATLANTIC TRAVEL, registration no. 40003692248 is a guarantee that, in the event that it fails to fulfill its obligations due to its liquidity problems, AAS “BALTA” and the Center for the Protection of Consumer Rights provide.
If SIA ATLANTIC TRAVEL, registration no. 40003692248 is unable to fully or partially fulfill its obligations and provide the relevant services due to its liquidity problems, the traveler may contact the Consumer Rights Protection Center at 55 Brīvības street, Riga, LV – 1010, pasts@ptac.gov.lv, tel. 65452554.
